WorkOn License Agreement
Important: please read the following license agreement carefully before installing and using this application.
This End User License Agreement (“Agreement”) constitutes the entire agreement between you (whether an individual user or a business organization) and LODESTAR COMMUNICATIONS LTD. (whether an individual user or a business organization) and LODESTAR COMMUNICATIONS LTD. By installing, copying, or using the Application on your computer, you agree to be bound by the terms of this Agreement. This Agreement constitutes the entire agreement between you and LODESTAR COMMUNICATIONS LTD. (“Licensor”) with respect to the use of the Application, and this Agreement supersedes all prior proposals, representations and understandings you may have made with LODESTAR COMMUNICATIONS LTD. with respect to the Application. This Agreement supersedes all prior proposals, representations and understandings you may have made with LODESTAR COMMUNICATIONS LTD. regarding the Application. If you do not agree to the terms of this Agreement, you may not install or use the Application.
The APPRICATION is protected by copyright laws, international copyright treaties, and all other intellectual property laws and treaties. By agreeing to the terms and conditions of this agreement, you acquire the right to use the software (license), but you do not acquire the application itself.
1. Grant of license
This Application is licensed as follows
(a) Installation and Use
LODESTAR COMMUNICATIONS LTD. grants you the right to install and use the Application on any computer that holds a valid license for the operating system for which the Application is designated.
(b) Backup and Copy
You may backup or copy of the APPLICATION for archival purposes.
(c) Free Version
The Free Version is provided free of charge in order to be able to demonstrate and evaluate the useful characteristics of the Application and to allow the End User to adopt a decision regarding the need to use the Application for a longer period of time. In the free version, some of the functions of this Application are limited and support services are not provided.
(d) Paid Version
The Paid Version is application that Licensor provides to end users for a fee. The Application can be installed and used without functional limitations on a specified number of devices within a specified period of time.
2. Other rights and restrictions
(a) Maintenance of Copyright Notice
You may not remove or alter the copyright notice from the Application
(b) Distribution
You may not copy, share, distribute, resell, offer for resale, transfer, or sublicense the Application, related materials, or the license granted herein.
(c) No Reverse Engineering, Decompiling, or Disassembling
You may not reverse engineer, decompile, or disassemble the Application, except to the extent that such acts are expressly permitted under applicable law, notwithstanding the prohibition in this item.
(d) Rental
You may not rent, lease, or rented out the Application for free.
(e) Third Parties
The Application may contain software and other assets of third party suppliers. Some of which may or may not be identified in and/or licensed under this Agreement and/or the Agreement. Use of the Third Party Software is governed by the license terms set forth by those third parties. You may use such Third Party Software only in accordance with the license terms applicable to and accompanying such Third Party Software.
(f) Support Services
LODESTAR COMMUNICATIONS LTD. will provide support services for the Application.
Support Services are available only during the term of the paid version license. Support services are not provided for the free version.
Any application code provided as part of the support services shall be considered part of the APPLICATION and shall be subject to the terms of this AGREEMENT.
(g) Compliance and Applicable Law
You must comply with all applicable laws and regulations regarding the use of the Application.
3. Consent to use of data
You agree that LODESTAR COMMUNICATIONS LTD. may collect and use information submitted by you through this application, related materials, and/or collected in any way as part of the services provided to you. LODESTAR COMMUNICATIONS LTD. does not collect personally identifiable information from your computer during this process, LODESTAR COMMUNICATIONS LTD. may also use the information collected to improve and enhance the application and related materials and to provide you with notices that may be useful or of interest to you. The Application contains components that enable and facilitate the use of certain technologies and Internet-based services. You acknowledge and agree that LODESTAR COMMUNICATIONS LTD. may automatically check the version of the Application installed on your computer system and may provide updates, upgrades, or modifications to the So Application. you acknowledge and agree that this application may automatically check the version of the application installed on your computer system and may provide updates, upgrades or modifications to the application. 4. Termination of agreement
LODESTAR COMMUNICATIONS LTD. may terminate this Agreement without notice if you breach this Agreement. In this case, you will be required to destroy all copies of the Application.
5. Copyright
All proprietary and intellectual property rights in and to the Application and all proprietary and intellectual property rights in the Application are owned by LODESTAR COMMUNICATIONS LTD. or its suppliers. All copyrights and intellectual property rights in and to the content contained in or accessible through the Application are the property of their respective content authors and are protected by applicable copyright or intellectual property laws and treaties. All copyrights are owned by LODESTAR COMMUNICATIONS LTD. unless otherwise noted.
6. Disclaimer
LODESTAR COMMUNICATIONS LTD. makes no warranty of any kind for this application. this application is provided on an “as is” and “as available” basis without warranty of any kind and without warranty of any kind, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. LODESTAR COMMUNICATIONS LTD. makes no warranties that the information, text, graphics, links, or other items related to this application will be complete or error-free. lodestar communications ltd. does not warrant the completeness of any information, text, images, links, or other items related to this application, nor does lodestar communications ltd. warrant any damages resulting from computer viruses, worms, time bombs, logic bombs, or any other such programs. lodestar communications ltd. disclaims any and all warranties to the user of this application and any related third parties.
7. limitation of liability
In any case, LODESTAR COMMUNICATIONS LTD. shall not liable to you for any direct, indirect, consequential, punitive, special or incidental damages (indefinite, including lost profits, business interruption, loss of information) arising out of the use or inability to use the application, even if advised of the possibility of such damages, In no event shall we be liable for any direct, indirect, consequential, exemplary, punitive, special, or incidental damages (including, without limitation, lost profits, business interruption, or loss of information) arising out of the use or inability to use this application. LODESTAR COMMUNICATIONS LTD. shall not be liable for any violation of rights of defamation, publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, disclosure of personal or confidential information, including, but not limited to, any errors or omissions contained in this application or any portion thereof and shall not be liable for any infringement of the rights of any third party.
8. Modification of Terms of Use
LODESTAR COMMUNICATIONS LTD. may, in its sole discretion, change the terms and conditions of this Agreement from time to time. When these changes are made, LODESTAR COMMUNICATIONS LTD. will make the new Terms of Use available to you from within or through the Application or by other means of communication. You understand and agree that if you use the Application after the date on which the Application Terms of Use are changed, LODESTAR COMMUNICATIONS LTD. will treat your continued use of the Application as acceptance of the updated Terms of Use.
